The following constitute the terms and conditions to which applicants agree when paying for E-learning courses (“Terms & Conditions”). If you are agreeing to these Terms & Conditions as an individual, you are binding yourself to these Terms & Conditions. If you do not have such authority, or if you do not agree with these Terms & Conditions, you must not accept these Terms & Conditions and may not use the documentation, whether printed or available online, provided by DUKE Institute of Fitness and Sports in relation with the E-learning course. BY ACCEPTING THIS AGREEMENT BY CLICKING A BOX INDICATING YOUR ACCEPTANCE YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

Parties

This E-LEARNING AGREEMENT (“Agreement”) is made by and between DUKE Institute of Fitness and Sports (further in this document as Provider) and student (further in this document as User) enrolled with E-mail confirmed by the acceptance of these Terms and Conditions.

In consideration of the mutual promises and covenants in this Agreement, of which the receipt and sufficiency are hereby acknowledged, the Parties further agree to the terms as follows:

Services Provided

The Provider agrees to provide to User quality E-learning materials and access to E-Learning platform alongside following materials:

  • Access to E-Learning platform
  • E-learning materials (Lesson videos, Power Point Presentations, Quizzes, Reading Materials)
  • Delivery of the original final certificate.
  • Delivery of additional items such as hoodies, caps and other accessories if part of program package.

Pricing, Fees, and Payments

The User hereby agrees to pay the Provider a total sum of the amounts stated on the provider web page pricing list for the programs. By enrolling and providing the access to E-learning platform The Provider confirms that the User full field all his payment obligations.

Warranty and disclaimer

Provider ensures that all our E-learning materials are delivered diligently and in a good, workmanlike, timely and professional manner consistent with industry standards. The E-learning materials will be performed as described in the modules syllabus. Provider also ensures that all lecturers during this learning service are highly educated and full professionals in fitness and wellness industry.

Student obligations

User may not allow anyone else to access the e-learning courses via their log-in details. You must comply with all regulations and any other reasonable security requirements that apply at the premises at which the e-learning courses are provided. Provider reserves the right to remove any delegate from a e-learning course whose behavior is deemed inappropriate by Provider or its lecturers. In these circumstances, provider will neither refund any fees nor reimburse any other costs.

Ownership and Intellectual Property Rights

All E-learning materials is owned by Provider. All intellectual property rights in all E-learning materials available, including the design, graphics, text and videos are owned by Provider. When you are given access to the E-learning Material, you are granted a non-exclusive, non-transferable, revocable license to use the E-learning Material. No E-learning Material may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without Providers prior permission. Any such use is strictly prohibited and will constitute an infringement of Provider’s intellectual property rights. Providers solutions check on the consistency and quality of e-learning materials; all students will receive a follow-up email at the end of each class asking to submit feedback in the form of a satisfaction survey. This feedback will be reviewed in detail and will be used to make continuous improvements to class content and delivery.

Termination

This Agreement will automatically terminate on the Termination Date (180 days after the enrollment) unless terminated earlier by either party due to material or other obligation breach.

In case of lack of satisfaction with E-learning materials by the student, student can terminate this agreement 7 days after the enrollment and will receive refund of the tuition fee. If the notice is received 8 days or more after the enrollment provider is not obliged to make the refund.

Final certification uses and obligations

User is obliged to represent the Provider after receiving the final certification with ultimate respect and professionalism to any third party.

After the delivery of the final certification the Provider does not have any obligations or in any way can be related to the actions of the User. Any action and information provided by the User is full responsibility of the User and as such not in any correlation with E-learning materials provided by Provider. Also, by this Terms and Conditions the Provider decline any responsibility by the User action in the future related to potential User’s customers or client.

Privacy Policy

All information provided by you under these Terms & Conditions will be treated in accordance with Provider Privacy Policy.

Force majeure

Neither party shall be liable to the other for any delay or failure to perform any obligation under these Terms & Conditions (except for a failure to pay fees) if the delay or failure is due to unforeseen events which are beyond the reasonable control of such party, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or diminishment of power or telecommunications or data networks or services.

Entire Agreement and severability

This Agreement is the entire agreement between student and Provider relating to the training, E-learning materials and supersedes all prior or contemporaneous oral or written communications, proposals and representations with respect to the training or any other subject matter covered by these Terms & Conditions. If any provision of these Terms & Conditions is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect.

Governing Law

This Agreement will be governed by and construed according to the laws of Croatia.

Acceptance of the Terms and Conditions

By accepting these terms and conditions the User is obliged to respect all conditions of this agreement.

By enrolling student to E-learning materials and platform the Provider is accepted all terms and conditions of this agreement.
